Prenuptial Agreement

If prior to getting married, you wish to formally agree and record how your assets and liabilities will be divided if you get divorced, we can draft a prenuptial agreement for you. This can potentially protect the assets you take into a marriage, as well as offering peace of mind about your future finances.

It can be particularly important if there is a disparity between your financial circumstances and that of your fiancé, as well as if you have children from a former relationship to provide for. Prenuptial agreements should be regularly reviewed and amended to account for any significant changes in your circumstances.

Prenuptial agreements are not currently legally binding in England and Wales. However, following the case of Radmacher v Granatino in October 2010, courts are attaching more weight to prenuptial agreements and are likely to uphold them, unless they are deemed to be unfair, at the time of your divorce.

We recommend that a pre-nuptial agreement is signed at least 21 days before your wedding, so you should get in touch as soon as possible, if you are to be married and want to protect your assets.

Pre-civil Partnership Agreement

If prior to your civil partnership, you wish to formally agree and record how your assets and liabilities will be divided if your partnership gets dissolved, we can draft a pre-civil partnership agreement for you. The law for pre-civil partnership agreements follows that of prenuptial agreements.

Postnuptial Agreement

If, after your marriage, you wish to formally agree and record how your assets and liabilities will be divided if you get divorced, we can draft a postnuptial agreement for you. The law for postnuptial agreements follows that of prenuptial agreements.

Post-civil Partnership Agreement

If, after your civil partnership, you wish to formally agree and record how your assets and liabilities will be divided if your partnership gets dissolved, we can draft a post-civil partnership agreement for you. The law for post-civil partnership agreements follows that of prenuptial agreements.
