The prospect of ending a marriage and getting a divorce can be daunting; however, we can help.

You can apply for a divorce if you have been married for at least one year.

There is only one ground for divorce in England and Wales, and that is the irretrievable breakdown of your marriage. The court can only hold your marriage to have broken down irretrievably, if it satisfied of one, or more, of the following facts:

  1. that your spouse has committed adultery and that you find it intolerable to live with them;
  2. that your spouse has behaved in such a way that you cannot reasonably be expected to live with them;
  3. that your spouse has deserted you for a continuous period of at least two years;
  4. that you and your spouse have lived apart for a continuous period of at least two years and you both agree to getting a divorce;
  5. that you and your spouse have lived apart for a continuous period of at least five years.

The Divorce, Dissolution and Separation Act 2020 allowing for ‘no fault’ divorce is not currently available and is likely to be implemented in Autumn 2021.

If you wish to start divorce proceedings, we can advise you on the most appropriate fact for your circumstances and draft the divorce petition for you. Once this has been done, we can issue and progress your divorce online, which means that we can offer a fast and streamlined divorce service.  There is a £550 court fee for issuing a divorce petition.

If you have received a divorce petition and agree that your marriage has broken down irretrievably, we can advise you on completing the Acknowledgment form and draft this for you. Once this has been done, we can lodge it online to enable your divorce to progress.

If you do not agree that your marriage has broken down irretrievably, we can advise you about how you can defend proceedings and progress this for you.

The divorce process can be completed in 3 months but often takes longer due to court administration delays and the need to agree a financial settlement.
