As members of Resolution, we prefer to adopt a non-confrontational and constructive approach to dispute resolution wherever possible. We are therefore to help resolve your family law matter with mediation or private arbitration.

Mediation takes place with an independent third party, the mediator, who will attempt to assist you with reaching an agreement about finances and/or children matters; they are not there in an advisory capacity. The mediator will help you to find common ground and, as the cost is split between you, the cost can be lower than court proceedings. Mediation is also a prerequisite for court proceedings in many cases.

Arbitration is a relatively new but increasingly popular method for resolving disputes in family law. Arbitration can allow matters to be resolved faster than issuing court proceedings as you do not have to work to the court’s timetable and wait for court availability. If arbitration is agreed, you will sit before an arbitrator who will act as a judge and determine your matter. The decision will be legally binding.
