As members of Resolution, our Family Law Team prefers to adopt a non-confrontational and constructive approach to dispute resolution. We find that this attitude produces better results for our clients. We are able to offer mediation and collaborative law as an alternative to court proceedings. Mediation is, in any event, a prerequisite of court proceedings and many clients prefer to reach an agreement in mediation which saves time and money.

Mediation

Mediation takes place with an independent third party, the mediator, who is there to assist with reaching an agreement; they are not there in an advisory capacity. The mediator will help you to find common ground and, as the cost is split between you, the overall cost is generally much lower than court proceedings. Caroline Ford, our Family Partner, is able to offer MIAMS (Mediation Information and Assessment Meetings) as well as full mediation and collaborative law.

Collaborative law

Collaborative law takes place between two collaboratively trained solicitors and their respective clients. The parties sign up to an agreement confirming that they are committed to reaching an agreement without resorting to court intervention. If one party wishes to apply to court they will have to seek a new solicitor and start afresh, costing both additional time and money.

Arbitration

Arbitration is a relatively new method for resolving disputes in family law matters. Arbitration produces results much faster when compared to issuing court proceedings. All of the parties will sit before an arbitrator who will act as if they are adjudicating the matter in court and make a decision which is binding on all parties. Solicitors and Barristers can train to be arbitrators. The process is much quicker as you do not have to wait for a court hearing. However, arbitration is not for everyone, especially if you are suspicious that your partner may try to hide/deplete assets in an effort to prejudice your claim.

Another alternative to court is to reach an agreement with your former partner yourself. We can then assist with the drafting of a document outlining your agreement.
